MANDATES DON'T LOWER COSTS

Massachusetts Officials Concede Mandates Don't Lead To Universal Coverage. "Jon M. Kingsdale, executive director of the Commonwealth Health Insurance Connector Authority, the agency that markets the subsidized insurance policies...acknowledged that their universal coverage plan is not likely to be universal anytime soon. 'There's good evidence,' Mr. Kingsdale said, 'whether it's buying auto insurance or wearing seat belts or motorcycle helmets, that mandates don't work 100 percent.'" [New York Times. 11/25/07]

One In Five Uninsured In Massachusetts Will Be Exempt From The Mandate, Individual Mandate Would Only Apply To "Those Who Can Afford The Premiums." The Boston Globe reported, "Interestingly, the Commonwealth Health Insurance Connector Authority, the bureaucrats in charge of implementing the plan, decided that the universal individual mandate does not apply to everyone, but rather only those who can afford the premiums. Therefore, nearly one in five of the currently uninsured will be exempt from the law." [Boston Globe, 5/15/07]


15 MILLION IS A "DUBIOUS STATISTIC" TO USE WHEN DISCUSSING OBAMA'S PLAN

"Clinton Uses A Dubious Statistic When She Claims Obama's Plan Would Leave Out 15 Million Of The Uninsured." FactCheck.org reported, "Clinton uses a dubious statistic when she claims Obama's plan would leave out 15 million of the uninsured…Clinton based her claim on a column by The New Republic's Jonathan Cohn, who loosely estimated Obama's plan would leave 15 million uninsured…Cohn makes it clear here that he is offering an estimate based on the best information available, not a hard and fast calculation. Clinton's Claim "Based On Too Many Hypotheticals To Rate More Than A Half True." "It's a tough call, but because of the disagreements here, we find her claim to be based on too many hypotheticals to rate more than a Half True." [Politifact, 11/15/07]

DEBUNKED: Email Purporting to Be From Obama on Islam

In recent weeks a fraudulent email has circulated purporting to be from Senator Obama about Islam. Read the retraction The Muslim Observer wrote when they learned the letter wasn't true.

Last week (Volume 10 Issue 4) we printed an article, supposedly a letter by Senator Barack Obama, which detailed his childhood and his relations with Muslims and Islam over the years. The letter had been sent to us by a trusted friend of TMO. The letter seemed to us perfectly attuned to the sensibilities of Muslims, even though it clearly declared his actually being a Christian and not a Muslim.

It came to our attention shortly after our mass emailing last week that the letter was a fraud, actually written by a blogger named Umar Lee. The letter was widely circulated after being written by Mr. Lee, becoming "viral" in the emails of Muslims and this in fact is the way we received it. By the time we received it the letter did not have Umar Lee's signature at the bottom; the email said in fact that the letter had been sent to CAIR as an explanation of Obama's background.

We wish to print some statement on the issue from the Obama campaign. Therefore, we have made approximately 10 calls to different offices of the Obama campaign since Monday morning; we have left our contact information on every voicemail; we spoke at length with one volunteer for the campaign (who is not authorized to speak on behalf of the campaign) who explained that he thought the campaign staff might consider it unwise to respond on such an issue. We left two voice messages with Michael Ortiz, Senator Obama’s federal press secretary, and left one message with his campaign press office. But as of this writing, we have heard nothing from the campaign.

We at TMO are deeply embarrassed by what has happened, and because of this event we will implement changes in our policies regarding verification of outside submissions. Since we have limited staff and time for verification, we will be forced to rely more on our own paid writers and our subscription to news services rather than outside submissions.

Chicago Tribune, Factcheck.Org, Washington Post: Obama Never Represented Tony Rezko

FactCheck.org On Clinton's Claim Obama Represented Rezko: "That's Untrue." Factcheck.org reported, "Obama was associated with a law firm that represented the community groups working with Rezko on several deals. There's no evidence that Obama spent much time on them, and he never represented Rezko directly. So it was wrong for Clinton to say he was 'representing ... Rezko.' That's untrue." Chicago Tribune Review Of "Land And Court Document And Law Firm Files As Well As Correspondence And Other Records...Supports [Obama's] Contention That He Did Not Directly Represent Rezko's Development Firm." The Chicago Tribune reported, "Obama angrily rejected Clinton's accusation at Monday's Democratic debate. And a Tribune review of land and court documents and law firm files as well as correspondence and other records related to Obama's eight years as an Illinois state lawmaker supports his contention that he did not directly represent Rezko's development firm. Instead, the records show, he represented non-profit community groups that partnered with Rezko's firm." [Chicago Tribune, 1/23/08]

Tribune Examined Miner Barnhill's "260 Civil And Criminal Cases," IHDA And DOH Files, Clients From Obama's "Unusually Frank Ethics Disclosure Reports" And Found Obama Represented The Non-Profit Partner. The Chicago Tribune reported, "At the Tribune's request, Cook County Circuit Court Chief Judge Timothy Evans produced a list of all 260 civil and criminal cases in which the firm filed appearances, and the Tribune separately examined 1990s lawsuits that Rezmar Corp. listed in applications for government grants. The paper also examined files from the Illinois Housing Development Authority and the city housing department, as well as the hundreds of clients Obama listed in the unusually frank ethics disclosure reports he filed as a state senator from December 1995 through April 2004. Those and other records disclosed five instances in which Obama did legal work for ventures that included Rezmar Corp. The case of City of Chicago vs. Central Woodlawn Limited Partnership is one example. In 1992, that community group partnered with Rezmar Corp. to rehab the former slum apartment building at 6107-6115 S. Ellis Ave. As work was ongoing, city officials sued the developers, alleging 16 serious code violations at the property, including a dangerously dilapidated porch. Obama and a co-counsel filed appearances in February 1994, but the court records show they appeared on behalf of Central Woodlawn, Rezko's non-profit partner, not Rezko or his company." Washington Post Fact Check: "Investigations By Chicago Newspapers Have Not Produced Evidence That [Obama] Represented Rezko In A Slum Landlord Business." The Washington Post reported, "William Miceli, Obama's supervisor at the law firm, said the firm represented the Woodlawn Preservation and Investment Corp., a nonprofit group that redeveloped a run-down property on Chicago's South Side with Rezko. He called Clinton's assertion that Obama represented Rezko in a slum landlord business 'categorically untrue. He was a very junior lawyer at the time, who was given responsibility for basic due diligence, document review,' said Miceli, adding that Obama did what he was told by the firm. According to Miceli, that was the only time Obama worked on a Rezko-related project while at the law firm…But investigations by Chicago newspapers have not produced evidence that he represented Rezko in a slum landlord business. What has been demonstrated so far is that he did some due diligence legal work for a joint venture between Rezko and a Chicago nonprofit. Two Pinocchios for Clinton." [Washington Post, 1/22/08]

MINER: OBAMA DID MINOR WORK REPRESENTING THE NON-PROFIT

Miner: Obama Filed Incorporation Papers For The Non-Profits. The AP reported, "Attorneys there say Obama never represented Rezko directly. The future senator did represent community organizations that were Rezko partners in rehabilitating buildings to provide apartments for the poor…Judson Miner, a partner in the firm, said that Obama's role was small. He said Obama did perhaps six or seven hours of work on such projects, mainly filing incorporation papers for the nonprofit groups." [AP, 1/22/08]

Obama Said That Miner Barnhill "Was Representing The Non-For-Profit Partner, Where There's No Allegations That They Did Anything Wrong." Obama said, "My law firm was representing the non for profit partner, where there's no allegations that they did anything wrong. They were simply trying to develop non for profit housing in the district." [Fox News, 4/24/07]

Obama Said That Miner Barnhill Was "Brought In Through [The Non-Profits], Not Through Rezko." The Chicago Tribune reported, "Responding to a Chicago Sun-Times report that Obama's former law firm did legal work for Rezko's low-income housing development business, the Illinois senator said he performed five hours of work on behalf of non-profit housing groups that partnered with Rezko. 'We were brought in through them [the non-profits], not through Rezko,' Obama said." [Chicago Tribune, 4/24/07]

Obama's Strong Record on Protecting Victims of Sexual Assault

Barack Obama: "The bill with respect to privacy for victims of sexual abuse is a bill I had actually sponsored...Nobody has worked harder than me in the Illinois state legislature to make sure that victims of sexual abuse were dealt with, partly because I've had family members who were victims of sexual abuse and I've got two daughters who I want to protect." Obama Was A Sponsor Of A Bill To Seal Sexual Assault Victim's Records, Voted For The Bill On The Floor

Obama Sponsored The Senate Version Of The Bill That Would Seal Sexual Assault Victim's Records. Obama sponsored a bill that would amend the Criminal Identification Act to provide that the victim of criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual abuse, or aggravated criminal sexual abuse, may request that the State's Attorney file a petition with the trial judge to have the court records of the case sealed. The bill provided that, upon order of the court for good cause shown, the records may be made available for public inspection. SB 943 Was Amended To Include The Exact Bill Language Of HB 854 Before Obama Signed On As A Sponsor. Obama was the chief co-sponsor of and voted for SB 943, which would amend the Criminal Identification Act to provide that the victim of criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual abuse, or aggravated criminal sexual abuse, may request that the State's Attorney file a petition with the trial judge to have the court records of the case sealed. ...But When The Illinois Press Association Raised Objections During Hearings On The House Version, Obama And Two Other Senators Voted Present In Committee On That Version Of The Bill

Illinois Press Association's Official Position On The Bill Was Opposition To It. Representative Lauren Beth Gash said, "[The Illinois Press Association] put in a slip in opposition in committee." Gash said the reporters could be in the court during the trial, but "if 10 years later they wanted to go back and find out the detail of the court records, they would not...have that then." Craven, General Counsel, Illinois Press Association: "This Is A Bad Bill." The Daily Herald reported, "Long after sexual assault victims have testified in court about their experiences, anyone can go in and read those accounts - a right one media group will fight to keep...Sealing records makes groups such as the American Civil Liberties Union and the Illinois Press Association a little nervous. 'This is a bad bill,' said Don Craven, general counsel for the Illinois Press Association and Illinois Broadcasters Association...The press association is opposed to any attempts to close public records." 3 Of The 4 Democrats On The Judiciary Committee Voted Present On This Bill. In committee, Senators Shadid and Silverstein joined Obama in voting present on HB 854. Obama Voted Present On The House Version On The Floor, Saying That It Was Typical For The General Assembly To Pass Bills To Show Political Resolve Even Though It Seemed The Bill Would Not Pass Constitutional Muster

Obama Voted Present On The Floor And In Committee On A House Bill That Would Seal Sexual Assault Victims' Court Records; Illinois Press Association And Obama Argued That The Bill Was Unconstitutional. Obama voted present on a bill to amend the Criminal Identification Act by allowing certain assault victims to petition to have their court records sealed, only to be opened for public inspection if good cause is shown. Under the bill the trials involving sex crimes would remain open, but upon a conviction, a victim of a sex crime could ask a state's attorney to petition a judge to seal the records of the case. If the judge agreed, the public could not open those records unless someone petitioned the court and showed good cause. The State Journal-Register reported, "But the Illinois Press Association argued that the measure violates the First Amendment. The U.S. Constitution does not allow judges to seal the records of trials that have been held in open court, said association attorney Don Craven. Besides, Craven argued, the legislation does not allow defendants the same opportunity if they're found not guilty. And there's no indication what would happen to the case files if the verdict were appealed. Sen. Barack Obama, D-Chicago, agreed that the bill probably wouldn't pass constitutional muster, although he said it's not unusual for his colleagues to pass such measures to show political resolve." Press Associations In Other States Raised Similar Objections To Similar Bills

When Similar Measures Were Passed In Other States Following A Scandal, The Press Raised Similar Constitutional Objections. The AP reported, "News executives in both states said the legislation was unnecessary and would hinder freedom of the press. 'It's another case where in order to achieve some possible good, legislatures are often willing to run right over basic constitutional rights,' said J. Randolph Murray, editor of The Anchorage Times in Alaska. 'We are against the thing because of the blanket restrictions it would impose,' said Doug Crews, executive director of the Missouri Press Association. 'Once a restriction such as this is made, where is the line drawn and where does it stop in the area of law enforcement records?'" [AP, 4/30/91]


Obama Has Passed Extremely Strong Sexual Assault Laws In the U.S. and Illinois Senates

Obama Passed The Dru Sjodin National Sex Offender Public Database Act of 2005. Obama co-sponsored a bill that would require the Attorney General to make publicly available in a registry via the Internet, from information contained in the National Sex Offender Registry or in state sex offender websites, specified information about sexually violent predators and persons convicted of a sexually violent offense or a criminal offense against a minor, who are required to register with a minimally sufficient state sexual offender registration program; and allow registry users to identify offenders who are currently residing within a specified radius of a given location. Requires registry information to include the offender's name, address, date of birth, physical description, and photograph, the nature and date of commission of the offense, and the date on which the offender is released from prison or placed on parole, supervised release, or probation. Linda Walker, Dru Sjodin's mother, said that Dru's Law "is a step in the right direction, but more work needs to be done to protect women and children. 'I think it has to stay in the forefront of our nation's agenda.' she said." Obama Passed A Bill To Protect Children From Known Sex Offenders. Obama co-sponsored a bill to improve the national program to register and monitor individuals who commit crimes against children or sex offenses. The bill would require the Attorney General to maintain a National Sex Offender Registry at the Federal Bureau of Investigation, as well as a National Sex Offender Public Registry. The bill would also require adults or juveniles who are convicted as adults of sexually violent offenses, certain offenses against minors, or other specified crimes (covered individuals) to provide specified information to designated persons in their domicile, work, or school states for the rest of their lives (with specified exceptions). The bill would require such an individual, initially and thereafter as specified, to register with and appear before such designated persons to provide identification, home, work, school, and vehicle information and to have a photograph and fingerprints taken. Obama Passed Law Expanding Rights Of Alleged Victims of Sexual Assault. Obama sponsored a bill and voted to amend the Criminal Code of 1961 to eliminate the 48 hour time requirement after the collection of the sample in which an alleged sexual assault survivor must return to the hospital performing the sample analysis of all controlled substances and alcohol ingested by the alleged victim a signed written authorization in order to have the sample analysis performed. Obama Passed A Law To Make Administering A Date Rape Drug Aggravated Battery As Well As An Aggravating Offense To Criminal Sexual Assault. Obama sponsored a bill and voted to amend the Criminal Code of 1961 to provide that administering a controlled substance to a person without his or her consent for nonmedical purposes constitutes aggravated battery. The bill provided that delivering a controlled substance to a victim without his or her consent as part of the same course of conduct as the commission of criminal sexual assault or criminal sexual abuse is an aggravating circumstance that enhances these offenses to aggravated criminal sexual assault or aggravated criminal sexual abuse. Obama Passed A Law to Expand the Definitions of "Sex Offender" and "Sex Offense" and Mandate Offender Disclosure. Obama sponsored a bill and voted to amend the Sex Offender Registration Act to include in the definition of "sex offender" a person who is convicted or adjudicated for a sex offense under the Uniform Code of Military Justice. The bill included in the definition of a "sex offense", a 3rd or subsequent conviction for public indecency or a conviction for custodial sexual misconduct or permitting sexual abuse of a child if these offenses are committed on or after the effective date of this amendatory Act. The bill provided that the sheriff shall disclose sex offender information to the boards of institutions of higher education or other appropriate administrative offices of each non-public institution of higher education located in the county where the sex offender is required to register, resides, or is attending an institution of higher education. Obama Passed Law To Require EMS For Sexual Assault Survivors To Include Coverage For Emergency Contraception. Obama was the chief co-sponsor and voted for adding, as an additional criterion for IDPH approval for a hospital's plan for emergency services for sexual assault survivors, that the plan must provide sufficient protections from the risk of pregnancy by the sexual assault survivor. Bill requires that hospitals providing such services develop and implement protocol that ensures that each sexual assault survivor receives medically and factually accurate information about emergency contraception. Obama Passed a Bill Eliminating Good Behavior Time For Sex Offenders. Obama sponsored and passed a bill to amend the County Jail Good Behavior Allowance Act by stipulating that any convict may not receive time off for good behavior if he has been incarcerated for sexual assault or aggravated sexual abuse. Obama Passed Law To Extend Statute Of Limitations On Certain Sexual Offenses. Obama Has Passed Extremely Strong Domestic Violence Laws In the U.S. and Illinois Senates

Obama Passed Law To Authorize The Violence Against Women Act Of 2005. Obama co-sponsored a bill that would authorize increased appropriations for FY2006-FY2010 for grants to combat violent crimes against women, revise provisions specifying purposes for grants to include use for underserved populations and for forensic medical exams of sex offense victims, increase set aside amounts for grants to Indian tribal governments and U.S. territories and possessions, prohibit law enforcement officers, prosecutors, or other government officials from requiring sex offense victims to submit to a polygraph examination as a condition for proceeding with an investigation or prosecution of a sex offense. The bill would establish a sexual assault services program, directing the Attorney General to make grants to states, territories, and tribal entities for rape crisis centers or other programs and projects to assist those victimized by sexual assault, culturally specific community-based organizations for various services on behalf of sexual assault victims, and state, territorial, and tribal sexual assault coalitions. The bill would also award grants to accredited schools of medicine to develop interdisciplinary training and education programs that provide health professions students with an understanding of, and clinical skills pertinent to, domestic violence, sexual assault, and dating violence. Obama Passed A Law To Create The Victims Economic Security And Safety Act (VESSA), Which Helps Victims Of Abuse Seek Treatment Without Losing Their Job. Obama was the chief sponsor and voted to created the Victims' Economic Security and Safety Act. The bill provided that an employee who is a victim of domestic or sexual violence, or who has a family or household member who is a victim of domestic or sexual violence, may take leave from work to address domestic or sexual violence by seeking medical attention or obtaining health or legal services. The Chicago Tribune reported, "But VESSA, as it is known, allows time off for personal issues not covered by the FMLA and is designed to help victims keep their jobs." Obama said he sponsored the bill after being approached by several advocacy group for battered women. "They came to me and indicated how difficult it is for victims of physical and sexual abuse to deal with the repercussions of an assault and then try to balance it with work and everything else." Obama Passed Law To Increase Penalties For Repeat Domestic Offenders. Obama was the chief co-sponsor and voted for House bill providing that domestic battery or a violation of an order of protection is a Class 4 felony if the defendant had a prior conviction for certain enumerated offenses, including first degree murder, aggravated domestic battery, and criminal sexual assault. A person commits stalking if he or she has been previously convicted of stalking another person and knowingly (on one occasion) follows that same person or commits certain threatening acts against that person or that person's family. Obama Passed Law To Increase Penalties For Committing Battery In Or Near A Domestic Violence Shelter. Obama was the chief co-sponsor of and voted for bill providing that a person commits aggravated battery if he or she (or the person battered) is in a domestic violence shelter, or if the person battered is within 500 feet going to or from the shelter. Obama Passed Law Improving "No Contact" Court Procedures in Domestic Abuse Petitions. Obama helped amend the Civil No Contact Order Act, including simplifying the forms for filing a petition. The law allows for the court to appoint counsel to represent the petitioner if the respondent is represented by counsel and changes what a civil no contact order may contain. Obama Passed Law Requiring Clear Language be Included in Emergency Orders of Protection. Obama co-sponsored and helped pass a law that requires the government be specific about the restrictions placed on the recipient of an emergency order of protection. Obama Passed Law Raising Standards Related to Domestic Violence. Obama sponsored a bill and voted to amend the Nursing Home Care Act and the Hospital Licensing Act to require licensees under those Acts to comply with standards relating to domestic violence established by the Joint Committee on Accreditation or other accrediting organizations approved by the Department of Public Health. Obama Passed An Amendment Into Law That Pressured The EPA to Comply With New Lead-Paint Regulations Seven Years After The Statutory Deadline. In 2005, Obama passed an amendment, which became law, to the FY 2006 Department of Interior Appropriations Act prohibiting the use of funds in the bill to delay or contravene implementation of an existing but unmet statutory requirement passed by Congress in 1992 that the EPA rewrite regulations on dispersal of lead paint by home remodeling contractors by October 1996. As of July 2005, the regulations still had not been written. Weeks after Obama's amendment passed the Senate, Obama received commitments in writing and during a Senate hearing that the EPA would comply with the law. Highlights of Obama's Strong Record of Accomplishment in the U.S. and Illinois Senate

Obama Was A Key Player In Assembling And Passing The 2007 Ethics Reform Law, Which Curbed The Influence Of Lobbyists And Was Described As The "Most Sweeping Since Watergate." In the first week of the 110th Congress, Obama joined with Senator Feingold to introduce a "Gold Standard" ethics package. Many of the Obama/Feingold bill's most important provisions were included in the final ethics reform package passed by the Senate in late January: a full ban on gifts and meals from lobbyists including those paid by the firms that employ lobbyists; an end to subsidized travel on corporate jets; full disclosure of who's sponsoring earmarks and for what purpose; additional restrictions to close the revolving door between public service and lobbying to ensure that public service isn't all about lining up a high-paying lobbying job; and requiring lobbyists to disclose the contributions that they "bundle" - that is, collect or arrange - for members of Congress, candidates, and party committees. The Washington Post wrote in an editorial that "...Mr. Reid, along with Sens. Russell Feingold (D-Wis.) and Barack Obama (D-Ill.), deserves credit for assembling and passing this package." In September 2007, the AP reported, "President Bush signed a bill Friday that will require lawmakers to disclose more about their efforts to fund pet projects and raise money from lobbyists, a measure that backers call the biggest ethics reform in decades...Sen. Barack Obama, D-Ill. who had pushed for the bundling provisions and was one of four lawmakers who participated in a Democratic conference call to reporters said the measure marks "the most sweeping ethics reform since Watergate." Obama Passed A Bill Creating A "Google-like" Database For The Public To Search Details About Federal Funding Awards. In 2006, Obama was an original cosponsor of a bill to create a "Google-like" database of information on federal spending. The bill requires the OMB by January 1, 2008, to make available to the public a searchable, free website that includes the (1) amount; (2) transaction type; (3) funding agency; (4) North American Industry Classification System code or Catalog of Federal Domestic Assistance number; (5) program source; (6) an award title descriptive of the purpose of each funding action; (7) the name and location of the recipient and the primary location of performance; and (8) a unique identifier of the recipient and any parent entity. The site must allow users to conduct separate searches that distinguish between awards that are grants, sub-grants, loans, cooperative agreements, and other forms of financial assistance and awards that are contracts, subcontracts, purchase orders, task orders, and delivery orders. Obama Passed Into Law Legislation Requiring Lobbyists To Disclose Their Bundling Activity, Making Him Unpopular Even Among Other Democrats. Obama sponsored an amendment to require lobbyists to disclose the candidates, leadership PACs, or political parties for whom they collect or arrange contributions, and the aggregate amount of the contributions collected or arranged. The amendment was passed by unanimous consent and attached to the Senate ethics bill, which was signed into law on September 15, 2007. The New York Times wrote, "The disclosure idea's lead sponsor, Senator Barack Obama... 'has not been the most popular person in our caucus in the last couple of weeks,' said a Democratic aide involved in deliberations over the bill." [S. Amdt. 41 to S. 1, S. Obama Passed Illinois Campaign Finance Reform, "Heralded As the Most Sweeping Good-Government Legislation in Decades." In 1998, Obama passed the Illinois Gift Ban that prohibited legislators, state officers and employees, and judges from soliciting or receiving gifts from a person or entity with interests affected by government. The bill required that statements of economic interest be made publicly available. The bill required public disclosure of any campaign funds received over $50, including the employer and occupation for donations over $500. The bill required non-profits and those registered under the Lobbyist Registration Act, and who give or accept more than $5,000 annually to register which the State Board of Election. The bill proscribed how campaign funds could be used, including ending the practice of allowing politicians to use campaign funds for personal use. The bill banned a political committee from receiving funds on government property and prohibited fundraisers held in Springfield while the legislature was in session. The bill required "Paid For" language to be printed on campaign literature. The bill required electronic filing of campaign disclosure as soon as technologically possible. Obama said, "'I have seen a general cynicism from taxpayers about government. They believe they have no influence on the process since they don't have the money of special interest groups. With the gift ban and the ban on Springfield fund-raisers that are contained in this legislation, I think at least some of this confidence will be restored,' the senator added." The Chicago Tribune reported, "Gov. Jim Edgar signed into law Wednesday an ethics and campaign finance package heralded as the most sweeping good-government legislation in decades. The law also required greater campaign finance disclosure and limited the uses for which raised money could be spent." Illinois Campaign for Political Reform: Sponsors Of Ethics Legislation "To Be Strongly Commended" For "Landmark Legislation." The leaders of the Illinois Campaign for Political Reform wrote, "The Illinois Campaign for Political Reform applauds the Illinois legislature for passing the bipartisan campaign finance and ethics package. The bill currently awaits Gov. Jim Edgar's signature. Shepherded by former U.S. Sen. Paul Simon (D-Ill.) and Mike Lawrence of Southern Illinois University's Institute for Public Policy, the bill's sponsors, state Sens. Kirk Dillard (R-Hinsdale) and Barack Obama (D-Chicago), and state Reps. Gary Hannig (D-Litchfield) and Jack Kubik (R-La Grange Park), made campaign finance reform in Illinois a reality by forging areas of common ground. Obama Passed Law Requiring Comprehensive Nuclear Threat Reduction Strategy To Secure Weapons And Usable Nuclear Material. "Senator Barack Obama (D-IL) and Representative Adam Schiff (D-CA) announced that a provision authored by Obama and Senator Hagel (R-NE) in the Senate and advanced by Schiff in the House requiring a comprehensive nuclear threat reduction plan passed as part of the omnibus appropriations bill. This provision requires the President to submit to Congress a comprehensive plan for ensuring that all nuclear weapons and weapons-usable material at vulnerable sites around the world are secure by 2012 from the threats that terrorists have shown they can pose. The Senate passed the omnibus appropriations bill last night and the House approved the same bill today. It will now be sent to the President to be signed into law…The Comprehensive Nuclear Threat Reduction provision requires the President to develop a strategy that will: ensure that all nuclear weapons and weapons-usable material at vulnerable sites around the world are secure by 2012 against the threats that terrorists have shown they can pose; ensure adequate accounting and security for such materials on an ongoing basis thereafter; include a plan for expanding the financial support and other assistance provided by other countries, particularly Russia, the European Union and its member states, China and Japan, for the purposes of securing nuclear weapons and weapons-usable material worldwide; and outline the progress in and impediments to securing an agreement from all countries that possess nuclear weapons or weapons-usable material on a set of global nuclear security standards, consistent with their obligation to comply with United Nations Security Council Resolution 1540." Obama Passed Legislation To Keep Weapons Of Mass Destruction Out Of The Hands Of Terrorists. In 2006, Obama was an original co-sponsor of legislation to expand U.S. cooperation to destroy conventional weapons. It also expands the State Department's ability to detect and interdict weapons and materials of mass destruction. Obama Passed Law to Promote Relief, Security, and Democracy in the Democratic Republic of the Congo. In 2005, Obama sponsored the Democratic Republic of the Congo Relief, Security, and Democracy Promotion Act of 2006. The bill would set forth specified U.S. political, social, civil, and economic policy objectives (policy objectives) with respect to the Democratic Republic of the Congo (DRC) and obligated a specified minimum amount of foreign assistance funding for FY2006-FY2007. HEALTH CARE

Obama Passed Bipartisan Legislation That Expanded Health Care Coverage To 154,000 Residents, Including 70,000 Children. In 2004, Obama sponsored and helped pass legislation that expanded and made permanent Illinois' KidCare program by raising eligibility from 185% to 200% of the federal poverty level. The legislation provided coverage for an additional 20,000 children and 65,000 more Illinois adults in the first year, and by 2007 had expanded health care to 70,000 kids and 84,000 adults. In its endorsement for his Senate race, the State Journal-Register wrote, "Obama brings similar common-sense views to improving health care in America - for example, as a state senator he championed the successful KidCare program that assists thousands of children of the working poor." Obama Passed A Bill To Create Hospital Report Cards To Assist Consumers; The Bill Was Sponsored By Members Of Both Parties. Obama was the chief sponsor of Hospital Report Card Act, a bill that provides specific requirements for staffing levels for nurses to ensure that the number of nurses is consistent with the types of nursing care needed by the patients and the capabilities of the staff. The bill also provides requirements for orientation, training of hospital staff, whistleblower protection and requires hospitals to prepare a quarterly report detailing specified information as a condition of licensure. Obama said that the Hospital Report Card would present information to consumers to inform their choices on health care decisions. Obama said, "If I want to go eat out in a restaurant, I can go online and find out details about the number and type of health code violations a restaurant has been cited for...But if I need to go into a hospital for open-heart surgery, I can't find out what the surgical infection rate has been for heart surgeries in that hospital. I'd say a lot more is at stake when I go in for surgery than when I go out to dinner...I think it's going to be very hard to argue against this Bill...Because, essentially, at this stage, all we are saying is that we need a consumer report for hospitals in this state." Obama Passed An Amendment Into Law That Pressured The EPA to Comply With New Lead-Paint Regulations After Seven Years of Delay. In 2005, Obama passed an amendment, which became law, to the FY 2006 Department of Interior Appropriations Act prohibiting the use of funds in the bill to delay or contravene implementation of an existing but unmet statutory requirement passed by Congress in 1992 that the EPA rewrite regulations on dispersal of lead paint by home remodeling contractors by October 1996. As of July 2005, the regulations still had not been written. Weeks after Obama’s amendment passed the Senate, Obama received commitments in writing and during a Senate hearing that the EPA would comply with the law. According to an Obama press release, "In 1992, Congress required the EPA to write regulations relating to the dispersal of lead paint by contractors during home remodeling by October, 1996. As of July 2005, these regulations still have not been written. In April, Administrator Johnson stated that to address the problem of lead paint poisoning, the EPA ‘will determine what additional steps may be necessary, including regulation’ despite the fact that the 1992 law does not say the regulations are optional." EPA Finally Published Nine-Years-Overdue Proposal For Lead Paint Regulations Four Months After Obama Passed Legislation And Held Up EPA Nominations. Building Products wrote, "The EPA recently published long-overdue proposed regulations that affect contractors working on older houses that contain lead-based paints. The regulations, if adopted, would require that contractors be trained in lead-safe work practices and be certified by the EPA. The rules also would impose protective standards for those working on houses with lead paint. In 1992, Congress directed the EPA to write regulations that would limit lead paint pollution during home remodeling by October 1996. By last summer, with no sign of the new regulations, U.S. Sen. Barack Obama, D-III., introduced more legislation designed to encourage the EPA to publish the rules. When that didn't work, Obama announced in the fall that he would block the appointment of every nominee to top EPA jobs until the agency produced the new rules. Obama Passed A Law Requiring The Defense Secretary To Report On The Pentagon's Efforts To Prepare For Military And Civilian Personnel For A Possible Influenza Outbreak. In 2006, Obama sponsored an amendment to the FY 2006 Defense Authorization Act that required the Secretary of Defense to report to Congress on the Pentagon's efforts to prepare for pandemic influenza, including pandemic avian influenza, including status on the procurement of vaccines, public health containment measures that could be implemented on military bases and other facilities; surge capacity for the provision of medical care during pandemics; surveillance efforts domestically and internationally and how such efforts are integrated with other ongoing surveillance systems; the integration of pandemic and response planning with those of other Federal departments; collaboration (as appropriate) with international entities engaged in pandemic preparedness and response. Obama Passed Legislation Providing $25 Million In Funding For Avian Flu Research And Containment Efforts By U.S. Agencies In South East Asia. "The amendment calls for greater investment in our preparedness efforts by providing more than $3 billion to build a stockpile of antiviral drugs and necessary medical supplies...Obama first introduced legislation in April requiring the United States to stockpile antiviral drugs...In May, Obama worked with a bipartisan group of Senators to appropriate the $25 million called for in the Foreign Assistance Act authorization bill. This money is currently being used by U.S. agencies in South East Asia to combat and contain possible outbreaks of avian flu." [Obama Press Release, 1/12/07]

Obama Passed Health Care Justice Act; IL's Largest Health Care Coalition Applauded Obama's Leadership In Passing the Bill. In 2004, Obama was chief sponsor of bill creating the Health Care Justice Act, providing that the State of Illinois shall implement a health care access plan that provides uniform benefits for all Illinois residents by establishing a Bipartisan Commission that is required to submit a report to form the basis for the health care access plan to: "1) Provides access to a full range of preventive, acute and long-term health care services; 2) Maintains and improves the quality of health care services offered to IL residents; 3) Provides portability of coverage regardless of employment status; 4) Provides core benefits for all IL residents; 4) Encourages regional and local consumer participation; 5) Contains cost-containment measures." The Journal Register wrote the bill was "amended to make full access to health care a goal instead of a policy and to strongly encourage, instead of require, the state to implement a health-care access plan." The bill passed. When the bill was funded in 2005, Jim Duffett, executive director of Campaign for Better Health Care, the largest health care coalition in Illinois, said, "We applaud the leadership of Governor Blagojevich, state Rep. William Delgado and former state Sen. Barack Obama, who were the chief sponsors of this act." Obama Passed Legislation Creating A Tax Credit For The Installation Of E-85 Fuel Pumps. In 2005, Obama introduced legislation that provided a tax credit for up to 50% of the cost of installing an E-85 pump. Obama passed the tax credit as an amendment to the 2005 transportation bill. The amendment was not included in the final version of the bill but was signed into law as part of the Energy Policy Act of 2005. The AP reported, "Under the provision, gas stations would get a tax credit to install equipment accommodating E-85 - an ethanol-based fuel alternative that its promoters say is up to 50 cents cheaper per gallon than unleaded gasoline. The credit would cover 30 percent of the installation costs at a given station up to $30,000...Freshman Sen. Barack Obama introduced the tax-credit measure in the Senate in the spring, and it was co-sponsored by Illinois' other Democratic senator, Dick Durbin. Obama also worked for the credit's inclusion in the energy bill as one of the conferees preparing the Senate-House conference committee report..." Obama Passed An Amendment Into Law To Fund Research For Hybrid/Flex Fuel Vehicles. In 2005, Obama sponsored an amendment, which was signed into law, to the Energy Policy Act that established an applied research program to improve technologies for the commercialization of a combination hybrid/flexible fuel vehicle; or a plug-in hybrid/flexible fuel vehicle. The program would provide grants with preference to proposals that achieve the greatest reduction in miles per gallon of petroleum fuel consumption, achieve not less than 250 miles per gallon of petroleum fuel consumption and have the greatest potential of commercialization to the general public within 5 years. Obama Passed Legislation Into Law Making Black Colleges Eligible For $15 Million In Federal Funding. In 2007, Obama introduced legislation that would make a predominantly black institution eligible for federal grant money. The legislation was written into the "The bill would define a PBI as a college of at least 1,000 undergraduates in which Blacks represent 40 percent or more of the student body. At least half of all undergraduates also must be low-income or first-generation students. The legislation would provide a minimum grant of $250,000. Jackson, another NAFEO board member, says Medgar Evers could find immediate uses for the funding." Obama Passed Into Law An Amendment Establishing A Grant Program To Support Summer Curricula That Emphasize Math And Problem Solving. In 2007, Obama sponsored an amendment, which became law, to the America Competes Act that established a competitive state grant program to support summer learning opportunities with curricula that emphasize mathematics and problem solving. MILITARY ISSUES/VETERANS

Obama Passed An Amendment, Which Became Law, Preventing The VA From Conducting A Review Of Post-Traumatic Stress Disorder Cases Aimed At Reducing Benefits. In 2005, Obama was an original cosponsor of an amendment that became law preventing the VA from conducting a review of cases, without first providing Congress with a complete report regarding the implementation of such review. In November 2005, the VA announced that it was abandoning its planned review. "Obama had several generations of veterans in mind, he suggested, when he joined fellow Democrats Richard Durbin (Ill.), Patty Murray (Wash.) and Daniel Akaka (Hawai'i) Sept. 22 on a successful amendment to block the Department of Veterans Affairs from reviewing case files of 72,000 veterans rated 100-percent disabled by post-traumatic stress disorder…VA officials believe some PTSD claims have been decided for veterans without proper documentation. They announced their massive review only after the VA inspector general studied 2,100 randomly selected cases of PTSD disability awards and found that 25 percent lacked documents to verify that a traumatic, service-connected incident occurred…But the Senate's amendment would bar the VA from conducting its case review until it justifies the program to Congress." Obama Passed Legislation, Which Became Law, Improving And Increasing Services For Homeless Veterans. In 2006, Congress passed a Veterans Affairs Committee bill which included several provisions originating in Obama's SAVE Act (S. 1180) and Homes for Heroes Act (S. 3475). "The legislation...includes a number of proposals from legislation Senator Obama had previously introduced (S.1180, the SAVE Act and S.3475 the Homes for Heroes Act) to expand and improve services for homeless veterans. The bill permanently authorizes and increases funding to $130 million per year for a competitive grant program to provide homeless services to veterans. It greatly increases a successful program to provide rental vouchers to homeless veterans. The legislation extends programs to providing treatment for veterans with mental illnesses and other special needs. Obama Passed Legislation Extending Tax Credits For Military Families By Allowing Service Members Deployed In War Zones To Apply Non-Taxable Combat Pay To The EITC. In 2006, Congress passed legislation based on a proposal sponsored by Obama, Kerry, and Pryor that extended tax credits for military families by allowing service members deployed to war zones to apply their non-taxable combat pay toward the Earned Income Tax Credit. The amendment was introduced during debate on the Senate’s 2006 tax reconciliation bill, ruled out of order, but later included in the Gulf Opportunity Zone Act, which passed both chambers and became law on December 22, 2005. Obama Passed An Amendment, Which Became Law, To Require The VA To Conduct A Campaign To Inform Disabled Vets Of Disparities In Compensation And Explaining Their Rights To Seek Review. In 2005, Obama was an original cosponsor on an amendment requiring the VA to conduct a campaign to inform veterans in Illinois, Indiana, Michigan, Connecticut, Ohio and New Jersey about their right to seek a review of their past claims. Specifically, the legislation required the VA to send letters to all veterans currently receiving disability who live in six states with a past history of below-average disability compensation, informing them of the past disparity, and explaining how to request a review of past claims and ratings and how to submit new claims. The VA was also required to inform all other veterans whose past claims may have been properly denied of this disparity by other means such as broadcast of print advertising. States whose average annual disability compensation payment was less than $7,300 qualified as below average. In 2003, Illinois veterans received an average of $6,802. Obama Passed Death Penalty Overhaul Package. Obama was the chief co-sponsor and voted for bill creating the Capital Punishment Reform Study Committee Act. Obama was the chief co-sponsor and voted for bill overhauling the death penalty in Illinois. The proposal was approved nearly unanimously. The bill would let judges rule out a death sentence for someone convicted solely on the testimony of a jailhouse informant, accomplice or single witness; let the state Supreme Court overturn a death sentence that was "fundamentally unjust.; Reduce the crimes eligible for the death penalty by focusing on "inherently violent" offenses; Expand defendants' access to genetic evidence used against them; Ban police officers from the police force if they committed perjury in a murder case; and Require juries to consider a defendant's history of abuse or mental illness when deciding whether to impose the death sentence. Obama Passed Law To Require Videotaped Interrogations In Capital Cases. Crafted from one of the findings of the Death Penalty Moratorium Commission of former Gov. Ryan, Obama was the chief sponsor and voted for a bill requiring the electronic recording of all homicide interrogations, conducts a police officer training program, and provides grants to local law enforcement agencies for the purchase of necessary equipment. A Chicago Tribune Editorial said, "Never underestimate the power of a good idea. Around the country, an impressive number of police chiefs and political leaders are warming to proposals to require the videotaping of police interrogations – a measure almost guaranteed to reduce the number of false confessions... Making a record that proves the confession was not coerced would go far toward reducing this shameful roster...The sponsor, Sen. Barack Obama, has made serious efforts in recent weeks to meet with the state's major law enforcement groups and accommodate most of their concerns... This isn't really about money, though. It's about old, entrenched institutions resisting change. Let's hope the Illinois Senate does not turn out to be one of them." Obama Passed Bill For Racial Profiling Law In Illinois, Was Praised For His Fight. Obama Passed Law Creating $100 Million Earned Income Tax Credit, Formed A Political Alliance Of Republicans And Democrats To Pass The EITC. Obama sponsored and passed a bill that amended the Illinois Income Tax Act to create the earned income tax credit. The bill provided that each individual taxpayer is entitled to a credit against the tax imposed by the Act in an amount equal to 5% of the federal earned income tax credit allowed. The credit applied to taxable years beginning on or after January 1, 2000 and ending on or before December 31, 2002. The credit may not reduce the taxpayer's liability to less than zero. The original legislation repealed the credit on June 1, 2003. Obama later passed legislation eliminating the sunset. The Chicago Tribune reported that the EITC was a bipartisan effort. "An unlikely political alliance has developed behind proposals to adjust the tax burden for working poor families. Obama Passed Law Creating The Illinois Temporary Assistance For Needy Families Program. Obama was a chief co-sponsor of the bill to create the state of Illinois' Temporary Assistance for Needy Families program. The bill created flexibility for victims of domestic violence, set a five-year limit for receiving public assistance, banned anyone convicted of a serious drug-related Class X or Class 1 felony from ever receiving assistance, required that all recipients develop a personal plan for self-sufficiency, listing the steps they will take to move from welfare to work, exempted those over 60 and adults with children younger than 1. According to the State Journal-Register, "The bill pours more money into day-care spending...as a result, an estimated 90,000 families would be able to take advantage of the child care benefit, subject to legislative appropriation of necessary funds. That represents a six-fold increase from the current number... State Sen. Barack Obama, D-Chicago, called the bill a good start but urged members not to rule out future changes to the system. He said there is a need for a commission to oversee the changes and ensure the system is working properly. '(Welfare recipients) generally are not represented down here in Springfield. Obama Passed A Bill Requiring Advance Notice Of Mass Layoff And Plant Closings. Obama was the chief sponsor of voted for bill requiring the Department of Employment Security to monitor compliance with the federal Worker Adjustment and Retraining Notification Act by private entities in Illinois. In January 2001, Obama announced plans to introduce Bill requiring employers to give 60 days advance notice of mass layoffs or plant closings to state officials to ensure timely unemployment assistance for workers. Under the Bill, the Illinois Department of Employment Security was required to monitor actively compliance with the 1988 federal Worker Adjustment and Retraining Notification Act, which already required employers to give the federal government 60 days notice of layoffs. Obama said he began working on the Bill after he discovered that employees at several Goldblatt's locations on the South Side had not received notification of impending layoffs before the stores closed. Obama was the chief co-sponsor and voted for a whistleblower bill that prevents employers from prohibiting an employee from disclosing information to a government or law enforcement agency if the employee has reasonable cause to believe that the information discloses a violation of State or federal law. Crain's Chicago Business wrote, "In April 2003, Obama-sponsored Bill that protected whistleblowers from employer retaliation passed the state Senate. Under SB 1872, workers who reasonably suspected violations of law had a legal right to report their fear to law enforcement agencies. Obama was the chief sponsor of a new law that exempted Illinois from the new federal overtime rules and protected overtime pay for thousands of our state's workers. The bill gave the 375,000 workers in Illinois who would have lost their right to receive pay for overtime under President Bush's new restrictions the compensation they deserve for the extra time they spend away from their families. Barack Obama, who led the push for Illinois to become the first state to block proposed federal rules on overtime pay, welcomed the Bush administration's changes Tuesday but said he isn't ready to reverse the state law. Obama And Hatch Passed Legislation To Protect Individuals' Rights To Continue Donating To Charities And Religious Organizations During Bankruptcy. In 2006, Obama was an original cosponsor of a bill that protected individuals' rights to continue donating to charities and religious organizations during bankruptcy proceedings. The Hatch-Obama bill responded to a court ruling that above-medium income debtors in Chapter 13 bankruptcy could not deduct charitable contributions, including religious contributions, from their payment plans. The ruling was based on an interpretation of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA). Hatch and Obama authored S. 4044 to ensure that all individuals in bankruptcy, no matter their income, would be able to continue giving to charity and their church. Obama Passed Equal Pay Act In Illinois To Give 330,000 More Women Protection From Pay Discrimination. Obama co-sponsored and voted for the Equal Pay Act which provided that no employer may discriminate between employees on the basis of sex by paying ages solely on the basis of the employee's gender. According to the AP, the "Illinois Equal Pay Act expands the federal Equal Pay Act of 1963 to give about 330,000 more women in the state protection from gender-based discrimination in pay" by applying the law to companies that employee 4 or more people, rather than the federal standard of fifteen. The bill provided that an employee who is a victim of domestic or sexual violence, or who has a family or household member who is a victim of domestic or sexual violence whose interests are not adverse to the employee, may take leave from work to address domestic or sexual violence by: seeking medical attention for, or recovering from, physical or psychological injuries caused by domestic or sexual violence to the employee or the employee's family or household member; obtaining services from a victim services organization for the employee or the employee's family or household member; obtaining psychological or other counseling for the employee or the employee's family or household member; participating in safety planning, temporarily or permanently relocating, or taking other actions to increase the safety of the employee or the employee's family or household member from future domestic or sexual violence or ensure economic security; or seeking legal assistance or remedies to ensure the health and safety of the employee or the employee's family or household member, including preparing for or participating in any civil or criminal legal proceeding related to or derived from domestic or sexual violence.
